Japan operates a power-tiered exemption: eFoils under 3 m and 1.5 kW with a kill-switch are licence-exempt, but international-spec boards (4–6 kW) require the Special Small Craft Operator Licence and JCI inspection. Domestic distributors sell power-limited Japan-spec models.
Regulatory overview
In Japan, eFoils sit inside the existing small-craft regime administered by MLIT (国土交通省) and enforced on the water by the Japan Coast Guard (海上保安庁), with vessel inspection carried out by the Japan Craft Inspection Organization (JCI). The Ship Officers and Small Craft Operators Act (Act No. 149 of 1951) is the governing law. Personal watercraft (水上オートバイ) ordinarily require the Special Small Craft Operator Licence (特殊小型船舶操縦士免許), but eFoils generally fall outside the special small craft category when sold in licence-exempt configuration.
The Act exempts vessels that are simultaneously under 3 m in registered length, fitted with propulsion of less than 1.5 kW (electric motors expressly included), and equipped with a kill-switch or propeller guard; such craft need neither a 小型船舶操縦士免許 nor a JCI 船舶検査. Most international-spec eFoils exceed 1.5 kW and therefore legally require a small-craft licence and inspection, so domestic distributors (Waydoo Japan, Takuma, Lift via SE Amusement) sell power-limited Japan-spec boards capped at roughly 20–22 km/h to remain licence- and inspection-exempt.
Designated swimming zones (遊泳区域), fishing-rights areas and many inland lakes (notably Lake Biwa, where Shiga Prefecture's Lake Biwa Recreational Use Ordinance restricts motorised craft and 2-stroke engines) impose additional motorised-craft restrictions enforced under prefectural ordinances. Special small craft (PWC) licence holders are limited to within 2 nautical miles of a mother ship or shore; licence-exempt eFoils are still subject to local maritime traffic and prefectural rules. Local 12 km/h or stricter speed limits apply within designated near-shore safety zones.
Active foiling regions include Okinawa (Fliteboard-certified schools and rentals concentrated outside reef swimming zones), Shonan/Kanagawa (offshore foiling subject to seasonal prefectural marine safety ordinances), Wakayama (coastal foiling tolerated; check Japan Coast Guard 11th Regional HQ notices), Lake Hamana (Shizuoka prefectural and harbour rules apply) and limited Lake Biwa use under prefectural confirmation. Lifejackets are required by both the Small Craft Operators Act and most commercial operators; helmets are recommended by the JCG and required by most schools. Operating any vessel under the influence of alcohol is prohibited.
