eFoil regulations & spots in Portugal

Portugal classifies eFoils, jet skis and other motorized boards together as embarcações de recreio (recreational watercraft) under the Regime Jurídico da Náutica de Recreio (Decreto-Lei n.º 93/2018, de 13 de novembro, as amended by DL 84/2019). Practically, an eFoil is treated as a mota de água / prancha motorizada: it must be registered (livrete eletrónico through SNEM), the operator must hold a Carta de Navegador de Recreio of an appropriate category, and a personal flotation device is mandatory at all times. The Direção-Geral de Recursos Naturais (DGRM) handles vessel classification and operator licensing, while the Autoridade Marítima Nacional (AMN/DGAM) and the Capitanias dos Portos handle registration of property, port oversight and local edicts.

Minimum operator age is 16 (Carta de Marinheiro, valid up to 3 nm from the coast and 10 nm from a sheltered harbour) and 18 for higher categories. For a Marinheiro between 16 and 18 the vessel is capped at 6 m and 22.5 kW, which covers all current consumer eFoils. Candidates must demonstrate swimming ability, present a medical certificate issued within 6 months, and complete an approved training course; foreigners can navigate with their home-state recreational licence under reciprocity rules.

Key navigational restrictions: jet skis and motorized boards may not navigate between sunset and sunrise, must keep clear of bathing zones, and must respect the 300-metre buffer from beaches and bathers at no more than 5 knots inside the buffer. Operations are forbidden or tightly restricted inside marine protected areas such as the Reserva Natural das Berlengas, the Parque Marinho Professor Luiz Saldanha (Arrábida), the Parque Natural do Sudoeste Alentejano e Costa Vicentina, and the cetacean sanctuaries around Madeira and the Azores. Launching is normally only allowed from licensed slipways or marinas, and rental operators must be commercially licensed by the local Capitania.

Enforcement is shared: the Polícia Marítima (within the AMN) is the primary authority at sea and on the foreshore, with the GNR/UCC patrolling beaches and inland waters; fines run from €50–€1,500 for individuals on minor breaches up to €300–€3,000 for unregistered or unlicensed operation. Madeira and the Azores apply DL 93/2018 but layer regional regulations through the Direções Regionais dos Assuntos do Mar; the Azores in particular impose stricter speed and distance rules near cetacean watching areas. Operators should always check the local Edital da Capitania before riding, as summer bathing-season edicts can further restrict zones in the Algarve, Cascais–Lisbon and Madeira coastlines.
