Regulatory overview
eFoils have no purpose-built statute in Mexico. They fall under the umbrella of the Ley de Navegación y Comercio Marítimos (LNCM) and its 2015 Reglamento, supplemented by the Reglamento de Turismo Náutico (DOF 2004) and NOM-034-SEMAR-2024, which sets minimum safety, signaling, communication and navigation equipment for national vessels up to 15 metres. SEMAR consolidated maritime authority from SCT in 2021 through DIGECAPAM (Dirección General de Capitanías de Puerto y Asuntos Marítimos), and Capitanías de Puerto issue matrículas, dimisorias, despachos and turismo náutico permits. Concessions over the Zona Federal Marítimo Terrestre (ZOFEMAT) are required for shore-based commercial launching.
Personal-use eFoils are typically treated as small recreational/sports craft (embarcaciones menores deportivas/recreativas). Mexican-flagged recreational vessels must obtain matrícula and abanderamiento at the local Capitanía de Puerto under the 2015 Reglamento. Foreign-owned craft brought temporarily to Mexico generally require a Temporary Import Permit (TIP) from Banjercito for vessels over 4.5 m; jet skis, kayaks and waverunners are commonly listed as exempt from TIP, but on-water liability insurance is mandatory in practice for rentals and recommended for owners. Mexico does not issue a federal recreational operator licence for sub-15 m pleasure craft, but commercial nautical-tourism operators must obtain a permit from the Capitanía de Puerto under the Reglamento de Turismo Náutico.
Capitanías de Puerto delimit bathing zones, navigation channels and speed-restricted areas; motorized recreational craft must stay outside swimmer zones and observe local Avisos a los Marinos issued by SEMAR's Dirección de Hidrografía. PFDs (chalecos salvavidas) certified to NOM-006-SEMAR are mandatory; kill-cord/leash, signaling devices and minimum safety kit follow NOM-034-SEMAR-2024. Despacho via la pesca/recreo or zarpe is required for trips outside the zona de seguridad of a port. Night operation, alcohol use and operating in restricted security zones around naval, port or Pemex installations are prohibited.
Many of Mexico's foiling-attractive coasts overlap CONANP-managed Áreas Naturales Protegidas where motorized recreation is restricted or prohibited. Parque Nacional Cabo Pulmo (Baja California Sur) is a no-take marine park; only authorized providers may conduct tourism inside the polygon, and PROFEPA in November 2025 seized a vessel doing unauthorized tourism, signalling active enforcement. Parque Nacional Arrecifes de Cozumel restricts navigation to designated channels; PWC-style use over reefs is effectively prohibited. Reserva de la Biosfera Sian Ka'an permits motorized navigation only in marked corridors per its Programa de Manejo. Operators must verify the Programa de Manejo and obtain CONANP authorization for any commercial activity, and detención de embarcación, multas under LNCM, and decomiso (seizure) are real risks for non-compliance.
